Terms & Conditions of Membership

  1. Elite Racing Club Limited (company number 03296044) ("the Club") confers on the Member (for the duration of their membership with the Club) certain benefits associated with horses owned by Elite Racing Club Limited. These horses include those currently in training plus those in a breeding programme. The benefits are as follows:
    1. an opportunity to follow every one of the horses in the Elite Racing Club string;
    2. to share the enjoyment of the Club's black and white racing colours; and
    3. where available, to receive a share in any of the prize money won by the horses owned by the company (Elite Racing Club Limited), in accordance with the terms and conditions herein.
  2. Prize money won by the horses owned by the company (Elite Racing Club Limited), (see (iii) below), during the period of membership is distributed equally amongst the Members who were current at the race date/time. There can never be any guarantee of any future level of prize money, given that this is dependent on how well the horses perform on the racecourse.
  3. The sum distributed to Elite Racing Club Members per relevant race is determined by the relative net total paid to the Club by Weatherbys (excluding VAT). The only additional deductions from the total GB race prize fund are all entry/supplement fees and racehorse transport and where the race is outside of Great Britain, the deductions also extend to trainer/jockey/groom/Elite Racing Club representative expenses. Any GBB (Great British Bonus), or similar, payments made to the Club, above prize money won, will be retained by the Club. If there are insufficient winnings from a particular race to cover the costs referenced above, these costs will instead be taken from the next available winnings to be paid, which may be from a different horse. In all circumstances the Elite Racing Club membership fee is not subject to any additional requests for payment in relation to the keeping and training of the racehorses, no matter what costs Elite Racing Club Limited may incur.
  4. Membership is primarily an entertainment. It is not an investment opportunity.
  5. If the Member chooses not to renew at the end of the membership period, the membership shall expire. There is no commitment to remain a Member after the 12 months membership period has expired.
  6. The membership fee shall include the provision of a regular copy of the Elite Racing Club Magazine, which is sent to the Member's email address, where registered. A Member is able to pay an additional sum during the purchase process to have a hard copy of the magazine printed and posted to their address (in addition to the email). In view of the unpredictable nature of the industry, no specific guarantees can be made in any respect. For example; whilst the intention is to maintain an average of 25 horses in the string (including broodmares, foals, yearlings and older horses in training) and to provide 12 magazines in a 12 months period, there are no specific guarantees. Indeed, some of the company's bloodstock may be sent to the sales or sold privately at anytime, and if sold, would no longer be associated with the Club or its Members.
  7. Consumer Legislation gives the consumer the right to cancel a new Membership contract they enter into with Elite Racing Club within 14 days of the date it is concluded (agreed). A consumer can cancel their new Membership by returning their membership pack within 14 days of purchase and Elite Racing Club will refund their payment in full.
  8. Hospitality events linked to a race meeting or stable visit, normally involve a 2 or 3 course lunch + facilities. Such optional offers will be charged at commercial rates.
  9. Some racecourses offer discounts to Club Members, and when offered, are published in the Club Magazine.
  10. When the Club has a runner, a telephone information line (NOT premium rate) and web/email service will endeavour to keep Members up-to-date with trainer information regarding the winning chances of the horse and this information (including that accessed through the website security PIN) must not be conveyed by Members to other people.
  11. All decisions relating to the horses, trainers, administration, and general management, shall be vested in the Club managers. Where a Member repeatedly fails to abide by the relevant dress code or acts in a manner which could cause harassment, embarrassment, offence or distress to another person, the offending Member may be instantly barred from attending any future events and may not be able to renew his/her Club Membership. If this is the case, computer software will automatically not permit further activity. The decision of the Managers in such circumstances shall be final and binding.
  12. Members can apply for a racecourse 'owners' badge when a Club horse runs. If an application is successful, Members will be able to enter the parade ring but not enter the pre-parade ring area. Note: the pre-parade ring is the area where horses are saddled and pre-paraded, before they make their way into the paddock or main parade area. The quantity of persons permitted to enter the paddock or main parade area is controlled by the racecourse and is limited to those persons who have been allocated an 'owners badge' for that particular race only. Persons entering any area of the racecourse on an unauthorised basis may be reported to the Stewards and this could result in a racecourse ban. Where the horse is Elite Syndicates-owned, (currently applies to General Medrano only) shareholders will receive one extra entry in the draw for each share held in the relevant horse. Flash photography is not permitted at any racecourse or any yard.
  13. If the company decides to retire a horse, the retirement procedure normally begins at EquiPrep, the company's own 126-acre site in Wiltshire. As well as receiving plenty of love and attention from the EquiPrep staff, an initial period of rest enables the horse to be assessed. We engage the services of rehoming centres to perform the task of preparing horses for a new discipline, once they have been assessed as ready to leave EquiPrep. Their task is to give specialist individual attention to each horse. This could take weeks, months or in some cases, years. Overall, this is an expensive procedure, hence why we currently make a small financial contribution when they take a retired horse on. The centre becomes the new owner and is then able to sell the horse for a fair market price, on a loan or outright basis, helping cover their overheads, marketing, staff, veterinary costs, farrier, etc… After all their costs are accounted for, any balance will become a profit to contribute to the success of their rehoming enterprise. The centre will make a profit on some horses and on others they will make a loss. Ideally, they will make an overall profit to sustain the longevity of their rehoming enterprise. Their overriding priority is to find a suitable forever loving home, and this responsibility involves thoroughly checking out the suitability of a prospective new owner.
  14. Membership is for the Member's personal use only and cannot be utilised for any commercial purpose.
  15. Additional postage costs are applicable to overseas Members.
  16. The benefits of being an Elite Racing Club Member are subject to regular review. Additional benefits may be introduced. Similarly, existing benefits may be withdrawn at any time.
  17. Copyright of all published material is the property of the Club. Material submitted by Members (letters to the editor, photographs etc) must be their own work and the full copyright shall pass to the Club. Photographs are not normally returned.
  18. Members must be aged 18 or over.
  19. It is understood by the Member;
    1. Full legal and equitable title to the Elite Racing Club horses' rests with the company, Elite Racing Club Limited.
    2. Club Members follow the progress of the horses owned by Elite Racing Club Limited and this constitutes the service provision.
    3. Elite Racing Club Limited is a company that primarily derives its income from the sale of Club memberships and from the sale of its bloodstock (including horses in the breeding programme). Consequently, the number of Club horses may vary from week-to-week as horses are purchased, sold, and bred.
    4. All rights conferred to the Member by the Club are personal to the Member alone and may not under any circumstances whatsoever be gifted, bequeathed, sold, assigned, leased, form part of a loan, offered or granted as security to any third parties.
  20. The name "Elite Racing Club" and the Club logo, and the name "Soviet Song" are registered trademarks.
  21. A Member can request the company to pay the whole or part of any eligible credit held in the Member's account at any time. Such payment shall be made by cheque and subject to the deduction of a £1 fee (inc. VAT) to cover the cost of administration, postage and bank charges. Note that some credits ('Future purchase credits') cannot be withdrawn (they can only be spent on a future share purchase). 'Future purchase credits' will be specifically stated on a Member's account statement. 'Future purchase credits' will be removed after 18 months of a Member not owning a current share with the company.
  22. Any person who is banned from entering a racecourse and/or 'warned off' by the BHA, cannot be a Member of Elite Racing Club.
  23. The copying of sections of the sentences used in these terms and conditions will be deemed an infringement of copyright, (the legal property of Elite Racing Club Limited).
  24. Whilst these terms and conditions are comprehensive, and we believe, compliant with fair trading practices prescribed by Consumer Protection Legislation, if you dispute any element of our service, your recourse is to write in the first instance, detailing the nature of your complaint and we will attempt to resolve the issue.   26. Elite Racing Club reserves the right to amend these Terms and Conditions at any time. Terms last updated 13/12/24.

Club Event Terms & Conditions

  1. Any tickets/booking confirmations issued remain the property of Elite Racing Club at all times and are subject to these Terms and Conditions.
  2. You may not re-sell or transfer a ticket/booking confirmation; they cannot be returned for a full or partial refund under any circumstances.
  3. Owners should call the Elite Racing Club information line before setting off for any event. If Elite Racing Club is aware in advance of any last-minute changes to schedule etc., this will be recorded on the information line.
  4. Admission to any event will only be granted on production of a valid ticket/booking confirmation, which must be available for inspection throughout the event. The right to refuse admission is reserved by Elite Racing Club and/or the event venue, who may take health and safety, environmental and security concerns into account at their reasonable discretion and may carry out security searches. No refunds will be offered to customers who are refused entry or ejected from a venue for any reason.
  5. Belongings must not be left unattended. Vehicles and their contents are left entirely at the risk of their owners.
  6. Events are subject to cancellation at short notice. Elite Racing Club shall not be responsible if any event is affected by weather, Covid, obstructions or any reason beyond its control. Elite Racing Club, and/or the event venue, reserves the right to abandon or cancel the event without notice and without being liable to pay compensation other than, at its sole discretion, up to a maximum of the event ticket price. Any refund offered may be subject to an administration fee.
  7. Elite Racing Club, and/or the event venue, reserves the right to make changes to the event details advertised without prior notice.
  8. Attending any event is at the client's own risk, and no responsibility can be accepted for any accident/injury or loss/damage to property. By attending the event, the client gives Elite Racing Club and/or the event venue their consent to use their image or likeness in any live or recorded video display, photo/picture, publicity material or website.
  9. Elite Racing Club clients are not permitted to utilise their membership (including through the attendance of any Elite Racing Club event) for any commercial purpose.
  10. Ownership or possession of a ticket does not confer any rights (by implication or otherwise) for the ticket holder to use, alter, copy, or otherwise deal with any of the symbols, trademarks, logos and/or intellectual property appearing on the ticket.
  11. Should there be an issue with your enjoyment of an event, please bring this to the immediate attention of Elite Racing Club event staff, who will endeavour to rectify any problem.
  12. Elite Racing Club reserves the right to refuse entry or any future bookings and eject visitors and/or their guests from a venue, for any reason deemed appropriate.
